Know your rights

Most restaurant workers are owed something they don't know they're owed. Tipped workers, in particular, are often paid the wrong way, denied breaks, or steered into illegal tip pools.

If your boss is doing any of this, you may have a claim

  • Paying you less than the local minimum wage when your tips don't make up the difference
  • Taking a cut of your tips, or forcing you to share tips with management or kitchen staff in jurisdictions that prohibit it
  • Making you work off the clock — setup, cleanup, side work — without pay
  • Retaliating against you for asking about pay, talking to coworkers about pay, or trying to organize
  • Refusing reasonable accommodations or breaks required by state law
  • Tolerating harassment from customers, coworkers, or managers
